General Terms of Use

Article 1 — Purpose

These General Terms of Use (hereinafter "GTU") define the conditions and terms of access to and use of the Breeve platform, published by BREEVE NETWORK LIMITED, a company incorporated under Irish law, registered under number 771347 at the Companies Registration Office, with its registered office at Ormond Building, 31-36 Ormond Quay Upper, Dublin, D07 EE37, Ireland (hereinafter "the Company").

The Company is established in Ireland and operates on the European market. Spiritual guidance services are provided by independent contractors located in Ireland, England, France, Tunisia, and other countries.

Any use of the Platform implies unreserved acceptance of these GTU by the User. If the User does not accept these GTU, they must refrain from using the Platform.

Article 2 — Definitions

he terms used in these GTU have the meaning attributed to them in the General Terms of Sale, to which these GTU are inseparably linked. The following additional terms apply:

Content: refers to any text, image, message, information, or data published, transmitted, or exchanged by the User in the course of using the Platform.

Code of Ethics: refers to all the ethical and deontological rules to which Psychic Advisors are subject in the performance of their consultations on the Platform.

Article 3 — Access to the Platform

The Platform is accessible via the website www.breeve.io and associated mobile applications. Access to the Platform requires an internet connection, the cost of which is borne exclusively by the User.

The Company uses reasonable means to ensure continuous access to the Platform. However, access may be temporarily suspended for maintenance, updates, technical improvements, or in cases of force majeure, without the Company being held liable in this regard.

The Company reserves the right to modify, suspend, or discontinue all or part of the Platform at any time, temporarily or permanently, without notice or compensation.

Article 4 — Registration and Account

4.1 — Account Creation

The User must create an Account to access the Services. Registration is free and reserved for natural persons aged eighteen (18) years or older.

Upon registration, the User provides a valid email address and creates a password. The User agrees to provide truthful and accurate information and to keep it up to date.

4.2 — Account Security

The User is solely responsible for maintaining the confidentiality of their login credentials. Any connection to the Account is presumed to have been made by the Account holder. The Company shall not be held liable for any unauthorized access to the Account resulting from the User's negligence in protecting their credentials.

4.3 — Restrictions

It is prohibited to create an Account on behalf of a minor or a person under legal protection (guardianship, curatorship, judicial safeguard). Each User may only hold one Account.

Article 5 — Description and Nature of the Services

5.1 — Qualification of Services

The Platform offers spiritual guidance consultation services for entertainment purposes, connecting Users with Psychic Advisors through written messages (chat) and/or telephone calls.

The User acknowledges and accepts that: — the Services are offered exclusively for entertainment and personal development purposes; — consultations do not constitute medical, psychological, psychiatric, legal, financial, or professional advice of any kind; — information communicated during consultations constitutes subjective interpretations of a symbolic, esoteric, or intuitive nature, without any scientific or factual value; — no guarantee of results, accuracy, or reliability is attached to the content of consultations; — predictions and interpretations delivered do not constitute commitments by the Company or the Psychic Advisor regarding the occurrence of future events; — decisions made by the User based on information obtained during consultations are the User's sole and entire responsibility; — the Services cannot substitute for consultation with a healthcare professional, legal professional, or any other qualified professional.

5.2 — Warnings

The User agrees not to interrupt, modify, or refuse medical or psychological treatment, not to make important financial decisions, and not to enter into, terminate, or modify a personal or professional relationship based exclusively on a consultation conducted on the Platform.

5.3 — Distress and Emergency Situations

The Services do not constitute a psychological assistance, prevention, or crisis intervention service. The Platform is neither designed nor adapted to support persons in psychological distress, immediate danger, or suicidal crisis.

The Company strongly recommends that any User experiencing distress or psychological suffering immediately contact: — 3114: national suicide prevention number (available 24/7, free and confidential); — 112: European emergency number; — 15: SAMU, in case of immediate danger; — a mental health professional (psychologist, psychiatrist) or their general practitioner.

The Company disclaims any liability in the event of damage resulting from the use of the Services by a person in a situation of psychological vulnerability who has not sought help from the relevant services.

Article 6 — Technical Operation of the Platform

The Platform relies on a technological infrastructure developed by the Company and its technical subcontractors. As part of the continuous improvement of the quality of the Services, the Company develops and deploys proprietary software tools and data processing systems designed to assist service providers in managing consultations, organizing communications, analyzing profiles, personalizing interactions, and assisting in drafting responses.

Consultations involve human intervention in the course of their delivery.

The Company uses third-party technical providers for hosting, payment processing, routing of communications, and operation of its software tools. These providers are subject to confidentiality and data protection obligations in accordance with applicable regulations.

The User acknowledges and accepts that the operation of the Platform involves the automated processing of certain data for the purposes described in the Privacy Policy.

Article 7 — Responsible Use

The User acknowledges using the Services autonomously, voluntarily, and responsibly. The Services are designed to provide a moment of guidance and entertainment and cannot substitute for regular professional support, whether medical, psychological, or of any other nature.

The Company does not encourage excessive or compulsive use of the Services. The User agrees to maintain reasonable and proportionate use of the Platform.

The Company reserves the right, at its sole discretion and without the User being entitled to any compensation, to: — temporarily or permanently limit access to the Services for any User whose usage appears manifestly excessive, compulsive, or detrimental to their own interests; — alert the User in cases of usage deemed excessive; — implement mechanisms to limit credit consumption over a given period.

The User acknowledges that the frequency and intensity of their use of the Services are their sole responsibility.

Article 8 — User Obligations

8.1 — Rules of Conduct

The User agrees to use the Platform fairly, in compliance with these GTU, applicable laws and regulations, and the rights of third parties.

The User is prohibited from: — publishing or transmitting any unlawful, defamatory, abusive, obscene, discriminatory, threatening content or content inciting hatred, violence, or any illegal activity; — harassing, threatening, intimidating, or undermining the dignity of Psychic Advisors or other Users; — attempting to obtain the personal contact details of Psychic Advisors or contacting them outside the Platform; — using the Platform for commercial prospecting, spam, or unsolicited advertising; — using automated devices (bots, scripts, crawlers) to access the Platform or extract data from it; — attempting to circumvent security measures, access the Company's computer systems, or disrupt the operation of the Platform; — creating multiple Accounts or impersonating a third party; — attempting to identify, reproduce, decompile, disassemble, or reverse-engineer the proprietary software tools, algorithms, data processing systems, or technologies used by the Company; — recording, capturing (by screenshot or any other means), reproducing, or publicly distributing the content of conversations or consultations conducted on the Platform, by any means and on any medium, without the prior written authorization of the Company.

8.2 — Content of Communications

The User is solely responsible for the Content they transmit in the course of using the Platform. The Company does not exercise prior editorial control over messages exchanged between the User and the Psychic Advisor.

However, the Company reserves the right to moderate after the fact any Content that is contrary to these GTU, the law, or public decency, and to take appropriate measures, including suspension or deletion of the Account.

Article 9 — Confidentiality of Communications

Consultations conducted on the Platform are confidential. The Company undertakes not to disclose the content of communications between the User and the Psychic Advisor to third parties, except as required by law or judicial order.

The conversation history is accessible to the User from their personal space for the duration of their Account. The User may request deletion of their history at any time by contacting customer support.

Psychic Advisors are subject to a confidentiality obligation under the Breeve Code of Ethics. Any breach of this obligation may result in the Psychic Advisor's removal from the Platform.

The User is prohibited from reproducing, capturing, recording, or distributing by any means (screenshot, audio or video recording, text copy, or any other process) the content of consultations conducted on the Platform. Any violation of this prohibition may result in the User's liability and immediate suspension or deletion of their Account, without prejudice to any legal action the Company reserves the right to bring.

Article 10 — Intellectual Property

The Platform and all of its components (architecture, design, source code, texts, graphics, logos, trademarks, databases, proprietary software tools, algorithms, data processing systems, and proprietary technologies) are protected by intellectual property laws and are the exclusive property of the Company or its rights holders.

Use of the Platform does not confer any intellectual property right on the User over any element whatsoever. The User is granted a personal, non-exclusive, non-transferable, and non-sublicensable license of use for the duration of their registration, solely for the purpose of using the Services in accordance with these GTU.

Any unauthorized reproduction, representation, modification, adaptation, translation, or exploitation of all or part of the Platform is strictly prohibited and constitutes infringement.

It is strictly prohibited for the User to reverse-engineer, decompile, disassemble, or attempt to extract the source code, algorithms, or functional logic of the proprietary software tools and technologies used by the Company in the delivery of the Services.

Article 11 — Personal Data Protection

The processing of Users' personal data is governed by the Privacy Policy accessible on the Platform, which forms an integral part of these GTU.

The Company processes Users' personal data as data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Irish legislation. The competent supervisory authority is the Irish Data Protection Commission (DPC). For any questions regarding the protection of their personal data, the User may contact the Company at help@breeve.io.

Article 12 — Limitation of Liability

The Company acts as a technical intermediary providing a Platform connecting Users and Psychic Advisors. As such: — the Company does not guarantee the permanent availability of the Platform or the absence of errors, bugs, or security flaws; — the Company cannot be held liable for the content of consultations between Users and Psychic Advisors; — the Company cannot be held liable for direct or indirect damages resulting from the use or inability to use the Platform; — the Company cannot be held liable for decisions made by the User based on information obtained during consultations; — the Company cannot be held liable for damages resulting from the use of the Services by a person in a situation of psychological, emotional, or mental vulnerability; — the Company cannot be held liable for any consequences, including financial consequences, resulting from excessive, compulsive, or unreasonable use of the Services; — the Company cannot be held liable for data loss resulting from a technical failure, subject to reasonable security measures implemented.

Article 13 — Moderation and Sanctions

The Company reserves the right, at any time and without notice, to: — limit, suspend, or delete the Account of any User in the event of a breach of these GTU or conduct that undermines the integrity of the Platform, its Users, or its Psychic Advisors; — delete any Content deemed contrary to these GTU, the law, or public decency; — report to the competent authorities any conduct that may constitute a criminal offence; — limit access to the Services in cases of usage deemed manifestly excessive or detrimental to the User's interests.

A User whose Account is suspended or deleted for breach of these GTU shall not be entitled to any refund of remaining credits or Cashback balance, unless otherwise decided by the Company.

Article 14 — Hyperlinks and Third-Party Services

The Platform may contain hyperlinks to third-party websites or services. The Company does not exercise any control over these sites and cannot be held liable for their content, their data protection practices, or their availability.

Article 15 — Notifications and Communications

The User agrees to receive communications from the Company relating to the operation of their Account and the Services (transactional notifications, security information, amendments to the GTU) by email or SMS at the address provided upon registration.

Commercial communications are only sent with the User's prior consent, and the User may unsubscribe at any time.

Article 16 — Amendment of the GTU

The Company reserves the right to amend these GTU at any time. Substantial amendments will be brought to the User's attention by notification within the application or by email, at least thirty (30) days before they take effect.

Continued use of the Platform after the amended GTU take effect constitutes acceptance of the new terms. If the User does not accept the new GTU, they may terminate their Account in accordance with the provisions herein.

Article 17 — Applicable Law and Jurisdiction

These GTU are governed by Irish law. Any dispute relating to the interpretation, performance, or termination of these GTU shall be subject to the exclusive jurisdiction of the Irish courts, subject to the mandatory provisions of the consumer law of the User's country of residence.

The User is informed of the possibility of using the European Commission's Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr.
