General Terms and Conditions of Sale (CGV)

The company Breeve, as a publisher of digital and multimedia content, operates the platform breeve.io, a reference platform dedicated to the distribution of its own content. This content is organized around several varied themes, including but not limited to: photography, cooking, fitness, beauty, life coaching, fortune-telling, as well as services specifically intended for an adult audience. This diversity allows Breeve to cater to the interests of different types of users.

On breeve.io, content is divided into two categories: public content, freely accessible to all users of the platform, and private content, which requires payment to be viewed. This model allows Breeve to offer a varied experience to users depending on their preferences and needs.

To facilitate access to private content, Breeve has implemented secure payment solutions through recognized payment service providers (PSPs). These services allow users to make their purchases quickly and securely, particularly via credit card. Each piece of content published on breeve.io is associated with a pseudonym of a producer or creator, who is the provider of the content available on the platform.

The mission of the breeve.io platform is to showcase the Media and Profiles of Creators and content providers. In some cases, it also allows direct interaction between creators and users, while ensuring that this interaction takes place under Breeve's strict control. This model guarantees compliance with applicable regulations and ensures consistent quality in the content and services offered on the platform.

Users of the platform can access free content, allowing them to explore and discover available offerings before deciding to purchase paid content. Paid content can be accessed via a one-time purchase (one-shot) or through a subscription, providing great flexibility in access based on user preferences.

It is important to note that Breeve acts as a merchant and publisher responsible for the content it purchases directly from Creators. As such, Breeve holds the status of publisher and ensures the quality and compliance of all content and interactions on the platform. As a publisher, Breeve assumes responsibility for all the content it broadcasts and strictly controls all exchanges between creators and users, fans, and subscribers.

The content broadcast on the breeve.io platform can come from two main sources:
1. Content published by Breeve: This content is directly managed by Breeve’s internal team, which is responsible for its creation, management, and updates.
2. Content offered by independent creators: These creators, whether they are producers or providers of multimedia content, operate under Breeve’s supervision and responsibility. The platform ensures that their content meets quality standards and complies with current regulations. It is understood that all direct meetings between Creators and Users of the platform are strictly prohibited.

ARTICLE 1: Purpose

These General Terms and Conditions of Sale (CGV) govern the sale of subscriptions (or the purchase of Media) and access to exclusive content offered by BREEVE NETWORK LIMITED on its online platform breeve.io. Any subscription order or sale of Media on the site implies the unconditional acceptance of these CGV. These terms are in addition to the General Terms and Conditions of Use (CGU) that govern the use of the Platform.

These General Terms and Conditions of Sale (CGV) govern all orders placed via the Platform, as long as it is accessible online. Dated with precision, they may be modified or updated by Breeve at any time. The CGV in force at the time of the order are those that apply, and subsequent versions will not alter orders already placed.

ARTICLE 2: Seller Identification

ARTICLE 3: Requirements

To make a purchase or subscribe to a membership on the breeve.io platform, the User must have the required legal capacity to make such a purchase, meaning they must either be:

  • A legal entity (a company or an organization legally constituted and registered, represented by an executive or any other person with the authority to legally bind it); or
  • A natural person (an individual of legal age, legally capable of entering into contracts on their behalf, and not subject to any legal protection measures such as guardianship or curatorship).

In the event of non-compliance with any of these conditions, the CGV may be terminated. It is the responsibility of the User to carefully read these CGV before finalizing any subscription or purchase of service and to expressly accept them.

The User must review these CGV with each new subscription, as the most recent version applies to any new order.

By confirming their order, the User confirms they have read the CGV and accepts them without reservation. They also acknowledge that they wish to have immediate access to the services or content provided and agree to waive their right of withdrawal in accordance with applicable legal provisions.

ARTICLE 4: Services Offered and Subscriptions

Breeve offers the sale of media on a one-shot basis as well as paid subscriptions allowing users to access exclusive content provided, where applicable, by content Creators. These subscriptions grant access to different levels of content depending on the categories chosen.

Subscription Terms:
Subscriptions are offered on a monthly basis. Each subscription grants access to the content for the duration of the subscription.

The content accessible depends on the subscription level chosen and the additional options selected by the User.

Pricing and Payment Terms
The prices of subscriptions or one-shot sales are indicated in euros, all taxes included. Subscription payment is made by credit card (Mastercard, Visa, etc.) or via secure payment methods such as [PayPal, etc.]. The subscription amount is debited recurrently based on the chosen frequency.

The User agrees to comply with the terms and conditions of the payment service providers (PSP) when using their services. The User guarantees Breeve that they have the necessary authorizations to use the selected payment method. Furthermore, the User will take all precautions to ensure the security and confidentiality of the information transmitted during the online payment on the Platform. It is specified that the payment data provided on the Platform is directly transmitted to the payment service provider and is not managed by Breeve.

Subject to the conditions linked to their bank account and agreements with their bank, the User's account will be debited as soon as the order is validated on the Platform. For Subscriptions, the User’s account will also be debited at each renewal of the said Subscription.

If the bank or payment provider refuses to proceed with the debit, the User must contact the Platform’s customer service to settle the order via another payment method accepted by Breeve. If, for any reason (opposition, rejection, etc.), the payment cannot be made, the order will be canceled, and the subscription or sale will be automatically terminated.

Duration and Renewal of Subscription


Automatic Renewal:
Subscriptions are automatically renewed at the end of each period (month or year), unless terminated by the User in accordance with the provisions of paragraph 4.

Termination by the User:
The User may terminate their subscription at any time via their personal space on the site. Any termination will take effect at the end of the current subscription period, and no refund will be made for the ongoing period.

ARTICLE 5: Right of Withdrawal

In accordance with the current regulations, the User has a right of withdrawal of 14 days from the subscription of the membership, unless they confirm their order with a request for immediate access to the content. In this case, the User explicitly waives their right of withdrawal, as defined by Irish law, in accordance with the Consumer Rights Act 2022, which transposes the European directives on consumer rights.

In this context, it is specified that no order (whether it is a Subscription, Media, or Lives) can be subject to a right of withdrawal once the service has started with the User's explicit consent. Under Article 20 of the Consumer Rights Act 2022, the right of withdrawal is not applicable to contracts for the supply of digital content not provided on a tangible medium, when the delivery of the content has begun after a clear agreement by the consumer, accompanied by a waiver of this right.

ARTICLE 6: Content Offered by Breeve

Creators retain full ownership of the copyright and image rights over the content they publish on the platform, for which they have transferred the exploitation rights to Breeve. Breeve holds the commercialization rights as the publisher of its platform. By subscribing to a membership, the User obtains a license to access the content without the right to reproduce, distribute, or modify it. Any violation of these rights may result in the immediate suspension or termination of the subscription without compensation.

ARTICLE 7: Intellectual Property

All content on the site, including texts, images, graphics, logos, videos, and software, is protected by intellectual property laws. Content published by Creators remains their exclusive property. Any use without explicit authorization is strictly prohibited.

ARTICLE 8: Personal Data Protection

Personal data collected during the subscription process is processed in accordance with GDPR. For more information on the collection, processing, and user rights regarding data protection, please consult our Privacy Policy.

ARTICLE 9: Limitation of Liability

Breeve cannot be held liable for temporary service interruptions, technical failures, or errors affecting access to content. In case of non-compliance of content, Breeve's liability is limited to providing an equivalent service or refunding the subscription.

ARTICLE 10: Dispute Resolution

In the event of a dispute regarding the application or interpretation of these CGV, the parties will endeavor to resolve the conflict amicably. If no amicable solution is found, the dispute will be brought before the competent courts in Dublin, Ireland.
